Terms and conditions of sale and delivery at Dansk Transport Emballage A/S

1. General

These terms and conditions of sale and delivery apply to purchases of goods at www.dtemballage.dk with delivery in Denmark, excluding Greenland and the Faroe Islands.

2. Ordering goods

You select the items you wish to purchase on the website and place them inyour"shopping cart." You can edit the contents of your shopping cart and check the contents and prices of the selected items at any time until you submit your order.

3. Acceptance and acknowledgment of receipt of order and order confirmation

When you place an order with us, you will receive an electronic receipt confirming our receipt of your order. The receipt is only an overview of the order, and a binding purchase agreement is only concluded upon receipt of an order confirmation from us. You agree that DTE may reject your order if the item is out of stock, contains significant errors, or if other circumstances prevent delivery as agreed.

The confirmation means that your order has been received and also contains information about the contents of the order, order number, name, delivery address, payment method, etc. This confirmation is only a service message so that you can see that your order has been entered correctly, but it does not mean that DTE has accepted your order.
By accepting the final order confirmation, you give DTE permission to deduct any additional costs from your payment – the goods will then be shipped.

4. Prices and payment

All prices on www.dtemballage.dk are in Danish kroner and exclude VAT and other taxes – we reserve the right to correct printing errors and changes in VAT and taxes. The following payment cards can be used for purchases in the webshop: Visa/Dankort, Visa, Master Card, JCB, American Express(no card fees are charged for their use).

The amount for your order will only be deducted from your account once the goods have been dispatched from DTE.
Card details are transmitted in encrypted form between your browser and DTE's systems, ensuring that your information is protected during transfer.

Dansk Transport Emballage A/S reserves the right to adjust prices in the event of changes in taxes, fees, or legislation that affect costs or price developments. This includes the right to retroactively invoice fees and taxes for extended producer responsibility (EPR). This applies if Danish authorities change the rules and DTE is subsequently subject to additional taxes.

5. Shipping and delivery

We strive to deliver ordered goods within eight business days of receiving an order. The shipping costs for your order will depend on the number of items, weight, and delivery location, among other factors.

6. 14-day right of withdrawal

As a consumer, you have a 14-day right of withdrawal. DTE may retroactively invoice fees and charges for EPR if the authorities change the rules and impose additional charges. You can also use a standard cancellation form, which can be downloaded here. The rules on the right of withdrawal do not apply to purchases made by businesses.

Goods procured specifically at the request of a customer are exempt from the right of withdrawal, unless otherwise agreed between the buyer and seller.

Cancellation and return of sealed goods that are not suitable for return for health or hygiene reasons and where the seal has been broken after delivery are not covered by Chapter 4 of the Consumer Agreements Act on the right of cancellation, cf. Section 18(2)(9) of the Act. 5. According to section 8(1)(9) of the Act, information must be provided if there is no right of withdrawal.

The right of withdrawal runs from the day you receive the item. If the deadline expires on a public holiday, Saturday, Constitution Day, Christmas Eve, or New Year's Eve, the deadline is extended to the following working day. For orders with multiple items or items delivered in multiple batches, the period does not start until the last item has been received.

If you regret your purchase, the goods must be returned to:

When returning goods, you should make sure that they are securely wrapped, as you are responsible for the goods until we receive them. Therefore, save the postal receipt and any track and trace number.

The return of sealed goods that are not suitable for return for health or hygiene reasons and where the seal has been broken after delivery is not covered by Chapter 4 of the Consumer Contracts Act on the right of withdrawal, cf. Section 18(2)(5) of the Act. According to Section 8(1)(9) of the Act, information must be provided if there is no right of withdrawal.

You are responsible for the cost of returning the goods if you cancel the purchase.

IMPORTANT: You must include a copy of the order confirmation or other documentation of your purchase. In addition, you must include our completed return form, which you can find here

Refund

When we receive the item, we will check it. You will be refunded the amount paid, including delivery costs, but excluding any additional costs incurred by choosing a delivery method other than the cheapest option. In the event of cancellation, the customer will always be charged delivery costs unless otherwise stipulated by law.

The amount will always be transferred to the same payment method you used for the purchase.

NOTE:

You may lose your purchase price, in whole or in part. This will happen if the value of the item has been reduced because

  • you have started using the product.
  • the item has been damaged while in your care.
  • hygiene seal is broken.
  • you have handled the goods in a manner other than was necessary to establish the nature, characteristics, and functioning of the goods.

7. Complaints

Your purchase is covered by the Sale of Goods Act, including the rules on defects. This means that you can have a defective item repaired, replaced, refunded, or receive a price reduction, depending on the situation. The complaint must be justified, and the defect must not be due to incorrect use or other damaging behavior.

You must submit your complaint within a "reasonable time" after discovering the defect. We recommend that you do so as soon as possible. Complaints submitted within two months of discovery are always considered timely.

Please provide detailed information about the defect and use our complaint form, which can be downloaded from our website. The form facilitates case processing and minimizes processing time. In the event of a justified complaint, we will refund reasonable shipping costs. If the complaint is not justified, you will be responsible for all expenses, including our investigation costs.

The item must be sent in secure packaging, and you must keep the receipt and any track & trace information, as you are responsible for the item until it is received. We only accept returns after prior agreement with an employee, where the return form is filled out with the contact person.

Please note that we do not accept packages sent cash on delivery or similar.

8. Personal data

To shop at www.dtemballage.dk, you must provide at least the following information:

  • Name
  • Address
  • Email address
  • Phone/mobile number
  • Delivery address
  • Whether the item may be returned without a receipt (for deliveries to private addresses)
  • Company name and address if the delivery address is a company and different from the billing address (specified when ordering).

The above data is stored for five years from the end of the financial year to which it relates. This is done in accordance with the Accounting Act, after which the information is deleted.

[If you have created a login to use our self-service, your personal information and order information will not be deleted unless you request us to do so] – but no earlier than after 5 years.

Information is not disclosed or sold to third parties, unless this occurs in connection with a restructuring or a full or partial sale of the company. Any disclosure in such a situation will be in accordance with the personal data legislation in force at any time.

As a customer, you have the right to access the information we register about you and to object to its use. Please send any inquiries in this regard to DTE by email at [email protected] in accordance with the Personal Data Act.

9. Cookies

By using www.dtemballage.dk, you accept that we use cookies. A cookie is a small data file that we place on your computer to keep track of what happens during your visit and to recognize your computer. A cookie is not a program and does not contain viruses.

10. Choice of law and jurisdiction

Purchases of goods on www.dtemballage.dk are subject to Danish law, and disputes shall be settled by the Danish courts.

Terms and conditions of sale and delivery at Dansk Transport Emballage A/S

(referred to as the seller)

1. Scope of the agreement

If the text of these terms and conditions of sale and delivery is used in connection with cooperation agreements, the text of these cooperation agreements shall take precedence over this text. These terms and conditions of sale and delivery shall be used in connection with the seller's general order confirmations. Unless otherwise agreed in writing between the parties, all deliveries are made on the basis of these terms and conditions. Any special terms and conditions specified in the buyer's order, letter of acceptance, or similar are therefore not binding on the seller.

2. Delivery

Unless otherwise stated, the terms of delivery are ex our warehouse. When the seller arranges transport from the warehouse to the buyer's address, this is done at the buyer's expense and risk. The goods are shipped from the seller's warehouse or directly from the manufacturer on the date stated on the order confirmation. Delayed delivery due to circumstances attributable to the seller only entitles the buyer to compensation if a special agreement has been made to this effect. Under no circumstances will the seller compensate for operating losses, loss of time, loss of profit, loss of earnings, or other indirect losses caused by delivery delays. If an order for a special item, including items with printing, has been placed by the buyer and production has commenced, the buyer is not entitled to cancel the purchase due to a delay.

3. Offer and acceptance

All offers made are binding for 14 days from the date of the offer, unless otherwise expressly stated. Once a written order confirmation has been sent, the order is binding. Changes or additions can only be made with the seller's acceptance and by sending the desired changes to the order confirmation in writing. Changes to the order confirmation may result in changes to the price and delivery time. The order can also only be canceled with the seller's prior acceptance. The order confirmation must be checked immediately upon receipt, as later complaints due to errors in the order printout will not be accepted.

4. Test materials

The seller will, to the best of its ability, advise the buyer on the choice of packaging for the buyer's product and supply sample material for testing. However, the responsibility for testing and choosing packaging rests with the buyer, unless otherwise agreed in writing. The properties and values of the packaging vary within a certain tolerance range. The actual deliveries cannot therefore be guaranteed to be test-compliant in the sense that they are 100% identical to the sample material supplied. The packaging is considered to be contractually delivered if its values are within the tolerance range normally applicable in the industry or if it corresponds to the specific quality specifications agreed in each individual case. Unless otherwise agreed, samples sent out that are not returned will be invoiced.

5. Prices

It is the buyer's responsibility to check that the price stated in the order confirmation is the same as the price stated in the offer. All prices quoted by the seller are in Danish kroner, excluding VAT and any other taxes, unless otherwise stated.

Dansk Transport Emballage A/S reserves the right to adjust prices at any time as a result of changes in taxes, fees, or legislation introduced by the Danish state or public authorities that affect the company’s cost base, competitiveness, or the general price level. This also includes the right to retroactively invoice fees and charges related to Extended Producer Responsibility (EPR) for goods previously exempt, should the Danish authorities implement changes that result in Dansk Transport Emballage A/S being legally required to pay additional charges.

6. Payment

Unless otherwise agreed, payment terms are 14 days net cash from the invoice date. For special items and items with printing, payment must always be made in advance when placing the order. If amounts due are not paid on time, interest will be charged in accordance with the Interest Act from the due date. A reminder fee of DKK 150 will be added to reminder letters.

7. Use of the goods

It is the buyer's responsibility to ensure that the delivered goods are suitable for the purpose for which the buyer wishes to use them.

8. Retention of title

Ownership of sold goods remains with the seller until all payment obligations to the seller have been fulfilled.

9. Duty to investigate

Upon delivery, the buyer must check that the goods have not been exposed to visible damage. Before using the goods, the buyer is obliged to carry out proper testing of the goods under realistic production conditions and to immediately halt production if the goods are not satisfactory.

10. Missing

If the buyer wishes to invoke defects, he must notify the seller in writing within 5 working days of receipt of the goods. In the event of visible damage, the buyer must also immediately make a note on the relevant consignment note. If an item is defective or faulty for which the seller is responsible, the seller must, within a reasonable period of time, replace, repair, or remedy the item at no cost to the buyer. If the aforementioned measures are not carried out within a reasonable period of time, the buyer is entitled to cancel the purchase. Beyond this, the seller has no liability for the defect or deficiency. No compensation will be paid for operating losses, loss of time, loss of profit, loss of earnings, or other indirect losses.

11. Returns

Intact merchandise in intact packaging will only be accepted for return by prior agreement and subject to a 20% deduction. Goods not stocked by the seller can only be returned by agreement with the seller or manufacturer.

As a consumer, you have a 30-day right of withdrawal from the date of receipt of the goods. If you wish to exercise your right of withdrawal, you must arrange and pay for the return shipment to our warehouse yourself. DTE can assist with the return shipment if you contact us. Shipping costs will be deducted from the amount we refund to you.

The right of withdrawal only applies if the item is returned in essentially the same condition and quantity as when you received it. The right lapses if the item is used in a way that clearly reduces its sales value.

The following items are exempt from the right of withdrawal:

  • Sealed goods that cannot be returned for health or hygiene reasons if the seal has been broken.

  • Goods delivered specifically according to the customer's order, unless otherwise agreed.

You are only liable for any diminished value resulting from handling other than what is necessary to assess the nature, characteristics, and functioning of the goods—as you would be allowed to do in a physical store.

If the item is used beyond this, it is considered used, and you may only receive a partial or no refund upon cancellation, depending on the commercial value of the item. For a full refund, the item must be treated as it would be in a physical store—you may inspect and try the item without actually using it.

12. Product liability

The seller is solely liable for property damage or personal injury caused by defective products if it is documented that the defect is due to error or negligence on the part of the seller that could not have been prevented by the buyer's inspection. The seller is not liable for indirect losses, including loss of business and profit, loss of time, punitive damages, or consequential costs.

The seller is also not liable for costs associated with returning or redelivery of resold products. If the seller is held liable for product liability towards third parties, the buyer must indemnify the seller within the same limitations. If a claim is made by a third party, that party must immediately notify the other party. The parties are mutually obliged to allow themselves to be sued or joined in the court or arbitration tribunal dealing with the claims. However, the mutual relationship between the seller and the buyer is always determined in accordance with the section on choice of law and jurisdiction.

13. Force majeure

The seller is not liable for delays due to force majeure or other circumstances that could not reasonably have been foreseen. In the event of such delays, the seller reserves the right to cancel the agreement in whole or in part or to postpone the delivery date by a reasonable period of time beyond the delivery date specified in the agreement. Force majeure includes, in particular, labor disputes, shortages of raw materials, labor shortages, failures in energy and water supplies, traffic disruptions, breakdowns of machinery, tools, and IT facilities, fire, war, mobilization, currency restrictions, blockades, political unrest, government intervention of various kinds, such as seizure, export and import bans, sabotage and vandalism directed at the seller's delivery facilities, as well as other similar impediments beyond the seller's control.

14. Choice of law and jurisdiction

Any dispute arising from the agreement entered into between the parties shall be settled by the Court in accordance with Danish law in a final and binding manner for both parties.

15. Freight

All prices are ex-warehouse Vojens (unless otherwise agreed).
Any shipping and handling fees will be added to the invoice when the goods are shipped.
